These Terms & Conditions govern access to and use of the SecretPrompt.ai website, the Naomi AI Virtual Assistant and related services provided through SecretPrompt.ai.

2. Nature of SecretPrompt.ai
SecretPrompt.ai provides technology, demonstrations and services related to artificial intelligence, including AI-powered virtual assistants, digital avatars and customised AI solutions.
The website may allow users to interact with demonstrations, communicate with an AI assistant, submit enquiries and contact SecretPrompt.ai regarding potential services or cooperation.
Unless expressly stated otherwise, information presented on the website does not constitute a binding commercial offer.
Submitting a contact form, providing an email address or communicating with Naomi does not by itself create a paid contract.
Specific commercial projects, customised AI avatars or other professional services may be subject to a separate quotation, agreement, statement of work or other contractual terms agreed with the client.
3. Naomi is an AI system
Naomi is an artificial intelligence-powered virtual assistant and digital avatar.
When you communicate with Naomi, you are interacting with an AI system and not with a human representative.
Naomi may use third-party artificial intelligence, speech-processing, voice-generation and avatar technologies to understand user input and generate responses.
AI-generated responses may occasionally be inaccurate, incomplete, outdated or inappropriate for a particular situation.
Users should independently verify important information before relying on it.
Naomi is not intended to provide regulated legal, medical, financial, tax or other professional advice.
4. Eligibility and professional use
SecretPrompt.ai is intended primarily for professional, business, informational and demonstration purposes.
You must be legally capable of entering into a binding agreement in order to purchase or commission paid services.
Persons under the age of 18 should not enter into a paid agreement with SecretPrompt.ai without the involvement of a parent or legal guardian where required by applicable law.
5. Acceptable use
You agree to use SecretPrompt.ai and Naomi lawfully and responsibly.
You must not use the service to:
engage in illegal or fraudulent activity;

Content generated by Naomi is created automatically using artificial intelligence.
SecretPrompt.ai does not guarantee that AI-generated responses will always be accurate, complete, error-free, unique or suitable for a particular purpose.
AI systems may generate similar or identical content for different users.
Users remain responsible for evaluating outputs before using them for business, commercial, professional or other important purposes.
Where AI-generated material is intended for publication or commercial use, users are responsible for ensuring that their particular use complies with applicable laws and third-party rights.
8. User-provided content
You retain any rights you have in information, prompts, text or other material that you submit through SecretPrompt.ai.
By submitting content that is necessary for the operation of the service, you authorise its processing to the extent necessary to provide the requested functionality.
You must not knowingly submit material that you do not have the right to use or disclose.
Please avoid submitting confidential, highly sensitive or special-category personal information unless it is genuinely necessary.

9. Intellectual property
The SecretPrompt.ai name, branding, website design, original graphics, logos, interface elements, original promotional materials and other original content created specifically for SecretPrompt.ai are protected by applicable intellectual-property laws.
Except where otherwise indicated, you may not copy, reproduce, distribute, sell, license or commercially exploit such materials without permission.
Third-party technology, trademarks, software and other materials remain the property of their respective owners.
Rights relating to customised deliverables created for individual clients may be governed by separate agreements between SecretPrompt.ai and the relevant client.
Nothing in these Terms transfers ownership of the SecretPrompt.ai brand or its proprietary materials to users.
10. Third-party technology
SecretPrompt.ai may rely on external technology providers, including AI-model providers, avatar platforms, voice-processing services, hosting providers, communication services and other infrastructure.
These may include services such as:
HeyGen / LiveAvatar for real-time avatar and voice functionality;
OpenAI for artificial intelligence processing and response generation;
Google / Gmail for communication and contact notifications;
and hosting, domain, server and infrastructure providers.
Availability or functionality of SecretPrompt.ai may therefore depend in part on third-party services outside our direct control.
Third-party services may also be subject to their own terms, policies and technical limitations.
11. Service availability
We aim to keep SecretPrompt.ai available and functional but do not guarantee uninterrupted or error-free availability.
The service may temporarily become unavailable because of maintenance, updates, infrastructure failures, third-party provider outages, security incidents or circumstances beyond reasonable control.
Features may be modified, replaced or discontinued as the technology and SecretPrompt.ai service evolve.
12. Commercial services and payments
Where SecretPrompt.ai provides paid customised services, the scope of the work, price, payment terms, delivery conditions and intellectual-property arrangements may be specified separately in a quotation, order confirmation, contract or other agreement.
Unless a specific online purchasing mechanism expressly states otherwise, interacting with Naomi or submitting a contact form does not create an obligation to purchase services.

14. Disclaimer
SecretPrompt.ai and Naomi are technology services and tools.
To the extent permitted by applicable law, services are provided without any guarantee that they will meet every user's individual requirements or that AI-generated information will always be accurate.
Users are responsible for decisions made on the basis of AI-generated content.
Nothing in these Terms excludes warranties, remedies or protections that cannot legally be excluded under applicable consumer law.
15. Limitation of liability
To the maximum extent permitted by applicable law, SecretPrompt.ai is not responsible for indirect or consequential losses resulting solely from reliance on AI-generated information or from circumstances reasonably outside its control.
This limitation does not apply where liability cannot legally be excluded or limited.
Nothing in these Terms excludes or limits liability for matters for which exclusion or limitation would be unlawful.
Mandatory statutory rights, including applicable consumer rights, remain unaffected.
16. Privacy and data protection
Use of SecretPrompt.ai may involve the processing of personal data.
Details concerning the collection, use, storage and sharing of personal data are provided in the SecretPrompt.ai Privacy Policy.
Users should review the Privacy Policy before providing personal information through the website or Naomi.
17. Changes to the service
SecretPrompt.ai may modify, improve or discontinue individual features where reasonably necessary, including in response to technological development, security considerations, third-party service changes or legal requirements.
Where a change materially affects an existing paid service, applicable contractual and consumer-protection requirements will be respected.
18. Changes to these Terms
These Terms & Conditions may be updated from time to time to reflect changes in the service, technology, applicable law or business model.
The latest version and update date will be published on the SecretPrompt.ai website.
Changes will not retroactively remove statutory rights that users already have.
19. Governing law
These Terms are governed by the laws of Poland, subject to any mandatory protections granted to consumers under applicable European Union law and the law of their country of residence.
